By use of the Service provided by Yellowbananas.Com, you do here-by accept the following conditions set forth in these Terms and Conditions. The right to use the Yellowbananas.Com Internet Access Account (Yellowbananas.Com Account) is not transferable unless approved in advance in writing by Yellowbananas.Com. Simultaneous logins of a standard dialup account are strictly prohibited and will result in the suspension of the account.
Billing:
Cash and Check Customers: Payment is to be made in advance. Subscriber agrees to pay Yellowbananas.Com 1 ½% late monthly service charge on bills rendered monthly and payable in full within twenty-one (21) days. Late payment may result in termination of service.
Credit Card Customers: The Subscriber agrees to pay all billed amounts according to this agreement until the Subscriber cancels the Yellowbananas.Com Account or discontinues credit card billing for another form of billing. Discontinuation of credit card billing should be requested in writing thirty (30) days in advance. Subscriber agrees this contract is binding and supersedes all personal credit card billing agreements. Subscriber agrees that faxed or other electronically transferred form of signature on these terms and conditions, or any other Yellowbananas.Com contractual information is binding.
Block Rate Customers: In the event subscriber wishes to cancel service prematurely, complete, unused months will be refunded after each whole or partially used month is calculated at standard billing rate for the services the subscriber was receiving. In no event will any portion of a partially used month be refunded.

Cancellation:

All Customers: A thirty (30) day written notification is required before cancellation of service. Only a written request to terminate your service relieves subscriber of obligation to pay the monthly Yellowbananas.Com Account charge. Yellowbananas.Com reserves the right to cancel a Subscriber immediately upon written notice if, according to the judgment of Yellowbananas.Com, the subscriber abuses use of their Yellowbananas.Com Account or is found to be in violation of this agreement. |

Yellowbananas.Com makes no warranties of any kind, whether expressed or implied, for the service it is providing. Yellowbananas.Com disclaims any warranty of merchantability or fitness for a particular purpose or other products or services received over the Internet. Use of any information obtained via Yellowbananas.Com and the Internet is at your own risk. Yellowbananas.Com specifically denies any responsibility for the accuracy or quality of information obtained through its services. Yellowbananas.Com Accounts may be used for lawful purposes only. Use of Yellowbananas.Com Accounts for lawful commercial and personal purposes is both permitted and encouraged. Transmission of any material in violation of any United States, State or local regulation is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, material protected by trade secret, or harassing. Subscriber agrees to indemnify and hold harmless Yellowbananas.Com from any claims resulting from use of the Yellowbananas.Com Account that damages you or another party. Hacking and Freaking on or via any Yellowbananas.Com System is strictly prohibited. Subscribers are specifically prohibited from posting any illegal pornographic material on any web or ftp site, personal or commercial housed by Yellowbananas.Com (System).
A Subscriber, who is found to have made available any illegal pornography in any way, on or via a System, or who has participated in Hacking or
Freaking, will have their account terminated immediately. If such account is terminated, any paid, unused months, whole or partial will not be refunded.
Yellowbananas.Com Account Subscribers are encouraged to access the Internet on a regular basis. There are no time restraints on Yellowbananas.Com Accounts. However, systems configured to automatically stay connected to Yellowbananas.Com are not authorized. If online business is complete, please disconnect. The system will disconnect you after an idle time of 30 minutes. The system will automatically disconnect the dialup session if you exceed maximum continuous connect time of 8 hours. If disconnected you may call back. However, Yellowbananas.Com dial-up lines are not personally dedicated 24hr lines. If a static connection is necessary, please inquire with our Sales Department for pricing and conditions of service. To allow fair access for all Yellowbananas.Com Accounts, Yellowbananas.Com discourages monopolizing the use of dial-up lines.
These disconnect times may change occasionally as necessary to ensure quality of service for all Subscribers. All unsolicited e-mail originating from Yellowbananas.Com Systems are to be transmitted in accordance with Federal law. All anti "spamming" regulations will be enforced. Violator’s account will be terminated and any paid, unused months, whole or partial will not be refunded. Using services to transmit any unsolicited commercial or bulk email, also called "spam". Attempts to distribute Spam may be subject to a $1.00 per message charge. The point at which email is considered "spam" is determined by Yellowbananas.Com and is generally when you send email to unknown recipients These Terms and Conditions reflect the entire agreement of the parties, and supersede all previous oral or written representations, understandings, agreements, and shall prevail notwithstanding any variance with terms and conditions of any order submitted. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United States of America, and the State of Pennsylvania.
